We can not provide shipping charges for oversized items, items drop shipped from the manufacturer, and items shipping outside the U.S. Final shipping charges will be added at the time the order ships.
Orders that include drop-shipped items (i.e. chemicals) may be charged separate
shipping and handling fees.
If a shipping method is not specified, we will determine the most expedient and efficient means of shipment. Appropriate charges (such as freight and insurance), provided by the various carriers used by Davis Instruments, will be added to your invoice. These charges are determined (at time of shipment) by product plus packaging weight, overall package dimensions, as well as any other special shipping requirements, such as HAZMAT materials. Your final shipping costs may differ.
Davis Instruments will not be liable for any claim,
loss, or damage caused in whole or in part
due to delay in or failure to make delivery
when such delay or failure is directly or
indirectly caused by act of God; strike or
other labor difficulty; transportation problems;
inability or delay in obtaining necessary labor,
material or products from usual sources;
material shortages; accident; act of any civil
or military authority; act of war; or act of
purchaser; or by the occurrence of any other
contingency beyond Davis Instruments’s reasonable
control. In such event, the date of delivery
or time for completion shall be postponed
by such length of time as may be reasonably
necessary to compensate for the delay.
Minimum Order: We appreciate all orders, so there is no minimum order requirement.
Warning - Product Use Limitation: The products within this catalog are not designed for nor intended for use in patient-connected applications including, but not limited to, medical and dental use, and accordingly have not been submitted for FDA approval.
Davis Instruments complies to the Texas Health and Safety Code, Sections through 481.081 which regulates the sale of laboratory apparatus. The law mandates businesses to obtain permits for the sale, purchase and transfer of such items.
It is our responsibility to determine if our customers receiving these goods are required to be permitted. We ask for your patience while we validate your licensing. On the event you do not have a current permit number and are not registered with the state of Texas to receive such items, then your order will be subject to delay until we obtain your current permit number, or we will not be able to process your order. We do apologize for the inconvenience this may cause you.
Warranty: Davis Instruments warrants
products sold against defects in material or
workmanship as follows:
Davis Instruments, at its option, will repair or
replace any defective product unit at no
charge, or refund the purchase price to
purchaser, provided that (i) the warranty
claim is made in writing within the period of
time specified in the catalog or in information
enclosed with the product packaging,
(ii) proof of purchase by bill of sale or
receipted invoice is submitted concurrently
with the claim and shows that the product is
within the applicable warranty period, and
(iii) the purchaser complies with Procedures
for Returns listed under the general Terms
and Conditions contained herein.
This warranty shall not apply to: (a) defects or
damage resulting from (i) misuse of the product,
(ii) use of the product in other than its
normal and customary manner, (iii) accident
or neglect, (iv) improper testing, operation,
maintenance, service, repair, installation, or
storage, (v) unauthorized alteration or modification;
or (b) post-expiration dated materials.
This warranty is the exclusive remedy of
the purchaser, and Davis Instruments disclaims
all other warranties, whether express,
implied or statutory, including without
limitation, warranties of merchantability
and fitness for a particular purpose.
No employee, agent, or representative
of Davis Instruments is authorized to bind
Davis Instruments to any other warranty. In
no event shall Davis Instruments be liable for
incidental or consequential damages.
All express and implied warranties, including the implied warranty of merchantability and the implied warranty of fitness for a particular purpose are expressively disclaimed and shall not apply to any products sold or services rendered hereunder. Davis Instruments shall not be liable for consequential, incidental, special, or other direct or indirect damages resulting from economic loss or property damage sustained by you or any end user from the use of the products sold or services rendered hereunder.
Recommendations made by Davis Instruments regarding the
properties, qualities, use or application of products sold by
Davis Instruments are believed to be reliable, but Davis Instruments
makes no representation or warranty whatsoever with respect
to any such recommendation, and expressly disclaims any and
all liability therefor. The Customer shall be solely
responsible for decisions regarding its uses or applications
of products purchased from Davis Instruments.
Claims: Your order is filled, checked, rechecked, and packed with great care. If damage has occurred, keep the carton and all of the
packing materials. Please report the details immediately to the carrier and then contact our Customer Contact Department.

Unless otherwise agreed in writing, all sales by Davis Instruments are subject to Davis' Terms and Conditions of Sale, which can be reviewed by clicking here, and which shall be controlling in the event of any conflict between these Terms and Conditions of Sale and the terms and conditions set forth in any document issued by the Buyer.
